This Agreement is a legal agreement between you and Fort Myers Grocery Service. Grocery and Gift Delivery Service. Fort Myers Grocery Service employees will shop and deliver grocery and gift orders placed with Fort Myers Grocery Service. Delivery will be made to the delivery address that you specify when you place your order. Payment for all grocery and gift delivery fees are due at the time of delivery. You are responsible for ensuring that someone is present at the delivery address to receive your delivery at the specified time of delivery. Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive the order. If Fort Myers Grocery Service cannot deliver your order, or must make an additional delivery because no one is at the delivery address to receive the order at the specified time, you will be assessed an additional fee.
If you are not satisfied for any reason with an item purchased through FMGS, we will return it for you. If an item you choose is not available at the grocery store, we reserve the right to replace the item with an equivalent product. We will adjust the price if the product is less, and we will not charge more if the product is more.
In some areas, you may choose to receive your Fort Myers Grocery Service order as an unattended delivery, and your order will be left unattended at your door or other place you designate. Orders containing tobacco or alcoholic products cannot be left unattended under any circumstances. FMGS may also choose to leave your order unattended in a convenient location if a person is not present to receive the delivery. Fort Myers Grocery Service is not responsible, and you agree not to hold FMGS or its employees responsible, for any damage or theft that occurs to an unattended delivery. FMGS reserves the right to refuse to leave an order unattended if the Fort Myers Grocery Service Delivery Driver considers the circumstances to be unsuitable or unsafe for any reason. Fort Myers Grocery Service may charge you a $35.00 fine if you agree to be present for a delivery and you are not.
Payment. You agree to pay each order in full before delivery. No deliveries will be made without payment unless, you have made arrangement before your delivery either by phone or email.
Unauthorized Use. Fort Myers Grocery Service does not offer the FMGS Service to children. By using the Fort Myers Grocery Service Service, you warrant that you are at least 18 years old. If you are under 18, you may use the FMGS Service only with the involvement of a parent or guardian.
Changes in Agreement or Fort Myers Grocery Service Service. FMGS may at any time change any of the terms of this agreement or the FMGS delivery fee schedule including, but not limited to, the amount of, or basis for determining, any fees or charges for the Fort Myers Grocery Service services. If FMGS makes material changes to this Agreement or changes to the FMGS delivery fee schedule, Fort Myers Grocery Service will provide notice to you on the page with an update notice. Your use of the Fort Myers Grocery Service services after any such change will be considered acceptable of such change. Fort Myers Grocery Service may discontinue or revise any or all aspects of the FMGS service without prior notice to you. Price and availability of products are also subject to change without notice. If any change is unacceptable to you, you may consider not using Fort Myers Grocery Service service.
Limitation of Liability and Disclaimer of Warranty. Your use of the Fort Myers Grocery Service service, www.fortmyersgroceryservice.com and the internet is entirely at your own risk.
